Article 1 – Definitions
The following definitions apply in these Terms and Conditions:
Cooling-off period: the period within which the consumer may exercise the right of withdrawal.
Consumer: the natural person who is not acting in the exercise of a profession or trade and who concludes a distance contract with the trader.
Day: calendar day.
Enduring transaction: a distance contract relating to a series of products and/or services, the obligation to deliver and/or purchase being spread over time.
Durable medium: any medium enabling the consumer or the trader to store information addressed personally to him in a way accessible for future reference and unaltered reproduction of the stored information.
Right of withdrawal: the possibility for the consumer to renounce the distance contract within the cooling-off period.
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.
Distance contract: an agreement whereby, within the framework of a system organised by the entrepreneur for the distance sale of products and/or services, until the conclusion of the contract, one or more distance communication techniques are used exclusively.
Technique of distance communication: means that can be used to conclude an agreement without the consumer and entrepreneur being in the same room at the same time.
General Terms and Conditions: these General Terms and Conditions of the entrepreneur.
Article 2 – Applicability
These general terms and conditions apply to all offers of the entrepreneur and to all distance contracts and orders concluded between OLIVIA KENSINGTON and the consumer.
Prior to the conclusion of the distance contract, the text of these general terms and conditions shall be made available to the consumer.
If one or more provisions are at any time wholly or partially null and void, the remainder of the agreement shall remain in force.
Article 3 – The Offer
The offer contains a complete and accurate description of the products offered.
All pictures, specifications and data in the offer are indicative.
All prices listed on OLIVIA KENSINGTON are exclusive of customs clearance costs and import VAT.
As the goods are fulfilled via international partners, delivery may take place from outside the customer’s country. Consequently, the courier service may collect import VAT and customs clearance fees from the recipient of the goods.

Article 5 – The Contract
The contract enters into force when the consumer accepts the offer and fulfils the conditions set out therein.
Once an order is placed on OLIVIA KENSINGTON, the trader shall immediately confirm receipt of the acceptance electronically.
Article 6 – Cancellation Policy
Orders are processed rapidly to ensure the fastest possible delivery.
If you wish to cancel your order, please contact our customer service immediately.
Due to our automated fulfillment system, once an order has moved into the processing stage, it may not be possible to stop shipment.
If an order cannot be cancelled in time, you maintain your right to return the item under the 14-day Right of Withdrawal (Article 7) once the package has been received.
Article 7 – Right of Withdrawal
When purchasing products from OLIVIA KENSINGTON, the consumer has the opportunity to dissolve the contract without giving reasons for a period of 14 days.
This cooling-off period begins on the day following receipt of the product.
During this period, the consumer shall treat the product and its packaging with care.
Article 8 – Costs in Case of Withdrawal
If the consumer makes use of the right of withdrawal, the costs of returning the products shall be borne by the consumer.
Returns must be sent to the designated return warehouse as instructed by customer service.
OLIVIA KENSINGTON shall refund the amount paid as soon as possible, but no later than 14 days after the consumer notifies us of the withdrawal, provided the product has been received back or conclusive proof of return is provided.
Article 9 – Exclusion of the Right of Withdrawal
The trader may exclude the consumer’s right of withdrawal for:

products created according to consumer specifications

products of a clearly personal nature

hygiene products whose seal has been broken by the consumer
Article 10 – Disputes
Contracts concluded between the trader and the consumer to which these general terms and conditions apply shall be governed exclusively by Polish law, even if the consumer resides abroad.
Article 11 – The Price and Responsibility
During the period of validity indicated in the offer, prices will not increase except for changes due to tax rates or statutory regulations.
While OLIVIA KENSINGTON utilizes international fulfillment partners to provide a wide range of goods, the operating entity remains responsible for the sales contract and customer service.
Import duties and VAT, if applicable, may be collected by the carrier upon delivery. These charges are the responsibility of the customer.
Article 12 – Conformity and Guarantee
The trader guarantees that the products comply with the contract and the specifications stated in the offer.
Defective or incorrectly delivered products must be reported to OLIVIA KENSINGTON in writing within 14 days of delivery.
Article 13 – Delivery and Implementation
The place of delivery is the address that the consumer has made known to the entrepreneur.
OLIVIA KENSINGTON undertakes to take the utmost care when receiving and executing orders.

Article 14 – Payment
Unless otherwise agreed, amounts owed by the consumer must be paid at the time of the transaction.
The consumer has a duty to immediately notify the entrepreneur of inaccuracies in the payment data provided.
Article 15 – Complaint Procedure
Complaints regarding the implementation of the contract must be submitted to OLIVIA KENSINGTON within 7 days in a complete and clearly described manner.
Complaints will be answered within 14 days from the date of receipt.
